Vibeyug (“Vibeyug”, “Platform”, “we”, “us”, or “our”) is a digital marketplace and professional discovery platform operated by EMEYC Pvt. Ltd. (“EMEYC”).

Vibeyug is designed to connect creators, creative professionals, businesses, clients, and other eligible users. The Platform may enable users to create professional profiles, showcase portfolios, discover creators and businesses, publish and respond to projects, submit and receive proposals, communicate with other users, arrange bookings, provide ratings and reviews, and access related marketplace services.

This Privacy Policy & Data Protection Notice (“Privacy Policy”) explains how we collect, use, process, disclose, retain, protect, and otherwise handle personal data in connection with Vibeyug.

This Privacy Policy also explains the rights and choices that may be available to individuals under applicable data-protection laws.

By creating an account or using Vibeyug, you acknowledge that you have read and understood this Privacy Policy. Where applicable law requires consent for a particular processing activity, Vibeyug will obtain consent in the manner required by law.

If you do not agree with this Privacy Policy, you should discontinue use of Vibeyug.

2. Who We Are

EMEYC is responsible for the operation and administration of Vibeyug and, where it determines the purposes and means of processing personal data, may act as the Data Fiduciary under applicable Indian data-protection law.

Certain Creator information is intended to facilitate professional discovery and may therefore be displayed to other users or publicly, depending on the relevant Platform functionality and settings. Creators should carefully consider what information they choose to publish.

7. Business and Client Information

Businesses and Clients may provide:

• Business name; Trading name; Business logo; Business description;
• Industry; Business category; Website; Business location;
• Contact information; Business registration or verification information;
• Project requirements; Project descriptions; Budgets;
• Event dates; Event locations; Hiring requirements;
• Proposals; Bookings; Ratings; Reviews; and
• Project-related communications.

Certain Business or Client information may be displayed to other users where reasonably necessary for marketplace and discovery functionality.

8. Project, Proposal and Booking Data

When a user creates, responds to, or participates in a project, proposal, or booking, Vibeyug may process:

• Project title; Project description; Category; Required skills;
• Budget; Location; Event date; Project timeline; Attachments;
• Proposals; Proposed pricing; Booking information;
• Project status; Completion information; Cancellation information;
• Reviews and ratings; and Related communications.

Information associated with a specific project, proposal, or booking may be made available to relevant participants to the extent reasonably necessary to facilitate the engagement.

9. Communication and Messaging Data

Where Vibeyug provides messaging or communication functionality, we may process:

• Conversation identifiers; Timestamps; Delivery status; Read status;
• Related project information; and Technical metadata associated with communications.

Communication data may be processed to deliver messages, maintain communication functionality, provide customer support, investigate abuse, prevent fraud, protect users, investigate security incidents, resolve disputes, and comply with applicable law.

Users should not knowingly share passwords, authentication codes, payment credentials, government identification numbers, or other sensitive security information through ordinary messaging.

Where Vibeyug provides payment, booking, commission, refund, settlement, or payout functionality, we may process information necessary to facilitate the relevant transaction. This may include:

Payment-card and banking credentials may be collected and processed directly by authorised third-party payment-service providers. Where appropriate, Vibeyug may receive limited transaction information rather than complete payment credentials.

When you access Vibeyug, we may automatically collect certain technical and usage information, including:

A Creator’s general location or service area may be displayed to facilitate discovery. Vibeyug does not intend to publicly disclose a user’s precise private location merely because the user accesses the Platform.

16. Withdrawal of Consent

Where processing is based on consent, users may withdraw consent in accordance with applicable law.

Withdrawal of consent does not affect the lawfulness of processing undertaken before withdrawal. Withdrawal may affect Vibeyug’s ability to provide certain features or services that depend on the relevant information.

Where required, Vibeyug will provide an appropriate mechanism for exercising the withdrawal.

17. Public Profiles and Marketplace Visibility

Vibeyug is designed as a professional discovery and marketplace platform. Accordingly, certain information may be publicly or semi-publicly accessible.

Creator information that may be displayed:

Name; Username; Profile image; Biography; Category; Skills; Services; Portfolio; Experience; Service area; Availability; Ratings; Reviews; and Verification status.

Business information that may be displayed:

Business name; Logo; Description; Industry; Website; General location; Ratings; Reviews; Verification status; and Public project information.

Private credentials and complete payment credentials are not intended to be publicly displayed.

18. Public Information and User Responsibility

Information deliberately published through a public profile, portfolio, public project, review, rating, or other public-facing area may be viewed, copied, downloaded, shared, reproduced, or otherwise used by other persons.

Vibeyug cannot guarantee the subsequent privacy of information that a user intentionally makes public. Users should not publish confidential, proprietary, financial, security-sensitive, or otherwise sensitive information in public areas.

19. User-Generated Content and Portfolios

Creators may upload creative works including photographs, videos, designs, documents, artwork, descriptions, and other materials. Users are responsible for ensuring that they have the necessary rights, licences, permissions, and authorisations to upload and display such content.

Users retain ownership of their original intellectual property unless separately agreed otherwise.

By uploading content to Vibeyug, you grant EMEYC and Vibeyug a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, display, format, resize, technically modify, and otherwise process that content to the extent reasonably necessary to:

• Operate Vibeyug; Provide portfolio functionality; Display profiles;
• Facilitate discovery; Provide marketplace functionality;
• Maintain backups; Maintain security; Troubleshoot technical systems; and
• Promote Vibeyug’s services where permitted by applicable law and consistent with applicable settings or agreements.

This licence does not transfer ownership of the underlying intellectual property to EMEYC.

20. Reviews, Ratings and User Content

Users may submit reviews, ratings, comments, portfolio materials, project descriptions, public profile information, and other user-generated content. Public submissions may be visible to other users.

Users are responsible for ensuring that submitted content is lawful, accurate where represented as factual, and does not infringe the rights of another person.

Vibeyug may moderate, restrict, remove, or disable content where reasonably necessary to enforce Platform policies, protect users, prevent abuse, maintain Platform integrity, comply with applicable law, or respond to valid legal requests.

21. Search, Discovery and Recommendations

Vibeyug may use information such as profile information, preferences, search activity, project requirements, service categories, interactions, engagement information, and platform usage to support search, discovery, ranking, matching, recommendations, and personalisation.

Recommendations and rankings do not constitute a guarantee, endorsement, or representation regarding the quality, suitability, availability, reliability, or performance of any Creator, Business, Project, or Service.

22. Third-Party Service Providers

Vibeyug may engage third-party service providers to support Platform operations. These may include providers of:

• Cloud infrastructure; Hosting; Databases; Storage; Content delivery;
• Payment processing; Payout services;
• Email; SMS; OTP services; Push notifications; Authentication;
• Analytics; Monitoring; Security; Customer support;
• Fraud prevention; and Other technology services.

Where a third party acts as a Data Processor on behalf of EMEYC, we will seek to maintain appropriate contractual, technical, and organisational safeguards consistent with applicable law.

Third parties that independently determine the purposes and means of processing may process information under their own privacy policies and legal obligations.

23. Data Sharing and Disclosure

We may disclose personal data where reasonably necessary for the purposes described in this Privacy Policy. Recipients may include:

We seek to limit disclosure to information reasonably necessary for the relevant purpose.

24. Corporate Transactions

If EMEYC or Vibeyug becomes involved in a merger, acquisition, restructuring, financing, investment, reorganisation, sale of assets, or transfer of substantially all relevant business operations, personal data may be transferred as part of the relevant transaction where permitted by law.

Any such transfer will remain subject to applicable privacy, confidentiality, and security requirements.

Security measures may vary depending on the nature of the information and associated risks. No electronic service or transmission method can be guaranteed to be completely secure.

If EMEYC becomes aware of a personal-data breach, we will assess, contain, investigate, mitigate, and respond to the incident in accordance with applicable law.

Where notification is required, Vibeyug will notify affected users and/or relevant authorities within the applicable timeframes and in the manner required by law.

28. Data Retention

We retain personal data only for as long as reasonably necessary for the purposes for which it was collected or processed, unless a longer period is required or permitted by applicable law. Retention may be necessary to:

• Provide Vibeyug services; Maintain user accounts;
• Facilitate projects and bookings; Maintain portfolio and profile functionality;

When personal data is no longer required, we may delete, anonymise, de-identify, or otherwise securely dispose of it, subject to applicable retention requirements.

29. Account Deletion

Users may request closure or deletion of their Vibeyug account through available account controls or by contacting us. Following deletion:

• The account may be deactivated;
• Public profile information may be removed or made unavailable;
• Certain user-generated content may no longer be publicly accessible;
• Transaction, project, payment, security, tax, accounting, legal, or regulatory records may be retained where required or reasonably necessary;
• Information independently copied or retained by other users may remain outside Vibeyug’s control; and
• Information contained in backups may remain for a limited period before being securely overwritten.

Deletion does not necessarily result in immediate destruction of every copy of information.

30. User Rights

Subject to applicable law, Data Principals may have rights including:

• Right to Access: The right to obtain information regarding personal data processed by Vibeyug and related information as provided by applicable law.
• Right to Correction: The right to request correction or updating of inaccurate or incomplete personal data.
• Right to Erasure: The right to request erasure of personal data where permitted by applicable law.

Vibeyug is a professional marketplace and is not designed to knowingly provide independent marketplace services to children where such activity is prohibited by applicable law.

Under the DPDP Act, a child is an individual who has not completed eighteen years of age. Where applicable law requires verifiable parental or lawful-guardian consent or imposes restrictions on the processing of children’s personal data, Vibeyug will implement appropriate measures.

Vibeyug will not knowingly process children’s personal data in a manner prohibited by applicable law. If you believe that a child has provided personal data to Vibeyug in circumstances where such processing is not permitted, please contact us.

34. Automated Processing

Vibeyug may use automated systems to support search, discovery, recommendations, ranking, matching, fraud detection, spam prevention, security, content moderation, and service improvement.

Automated systems may use information associated with an account or Platform activity. Where applicable law establishes specific requirements or safeguards concerning automated processing, Vibeyug will comply with those requirements.

35. Third-Party Links and Services

Vibeyug may contain links to third-party websites, social-media profiles, payment services, or other external services. EMEYC does not control the privacy practices of independent third parties.

Users should review the privacy policies and terms of those services before providing information directly to them.

36. Social Media and External Profiles

Creators and Businesses may voluntarily provide links to external websites or social-media profiles. Vibeyug may display such links as part of a professional profile.

Once a user leaves Vibeyug and interacts directly with a third-party platform, that third party’s privacy policy and terms may apply.

37. Accuracy of Information

Users are responsible for providing accurate, current, and complete information where required. Users should update their information when circumstances change.

Where appropriate and permitted by law, Vibeyug may take reasonable measures to maintain the accuracy of information or request verification.

38. User Responsibilities

Users are responsible for:

• Protecting their account credentials;
• Maintaining accurate account information;
• Controlling what information they publish;
• Obtaining necessary rights and permissions for uploaded content;
• Avoiding disclosure of sensitive credentials through public or ordinary communication channels;
• Complying with Vibeyug’s Terms and Conditions; and
• Using information obtained through Vibeyug only for lawful and authorised purposes.

Vibeyug intends to operate in accordance with applicable Indian laws and regulations relating to privacy, data protection, technology, consumer protection, intellectual property, payments, taxation, cybersecurity, and other matters relevant to its services. Depending on the circumstances and applicable provisions, this may include:

• Applicable consumer-protection laws;
• Applicable payment and financial regulations;
• Applicable intellectual-property laws; and

References in this Privacy Policy to legal requirements will be interpreted consistently with the provisions applicable and in force at the relevant time.

41. Severability

If any provision of this Privacy Policy is determined to be invalid, unlawful, or unenforceable, that provision will, to the extent legally permissible, be interpreted or modified to make it lawful and enforceable. The remaining provisions will continue to apply.
